Özet (EN)

People who belong to distinctive groups based on diffirent languages, ethnicities, religions and political sides have to abancon their homes and countries because of the fear arisen by constraint and cruelty. Refugee problem is as old as human history repeats itself every year, and stil there is no permanent solution on international status concerns. The article 14 of the Universal Declaration of Human Rights of refugee problem. Additionally, there are many international legislative documents which are also about this issue. Most important ones are 1951 Geneva Convention and 1967 Protocol. This study is going to be shaped according to 1951 Geneva Convention and Turkish Legislation.In the first part of the study, the refugee movements in the world history will be briefly explained. Then we will be listed national and international agreement with Turkish sources revelant the concept of asylum. Later, development right of asylum in Turkish law and new Turkish regulation are described. After that; we will be cleared refugees, asylum seekers, subsidiary protection and temporary protection, such as information about the people who will benefit from international protection, the necessary conditions for refugee status under Geneva Convention, the factors and the obstacles to be refugee, reasons which end the refugee status.In the second part, first of all, the recognition of individual rights and freedoms recognized refugee status criteria will be explained. Next, the rights granted to refugees under the Geneva Convention are explained evaluated together with Turkish law.In the conclusion, the problems which are experienced by refugees, the studies which carry out for refugees and inadequacies will be touched on.Key Words:1-Refugee2-Asylum Seeker3-Rights to Asylum4-Non-Refoulement5-Subsidiary Protection
