Witnesses protection in Turkish and Yemeni Criminal Law

Especially with the emergence of organized crimes and terrorist crimes, witnesses have started to have a more important role in criminal proceedings. In line with this, many countries have added various measures to their laws to prevent such crimes. Witness protection measures, which are the subject of our research, are one of these measures. Considering the threats that may arise against the witness in the trials related to certain crimes, the legislator has taken into account that the witness will need moral and material support in order to overcome the dangerous situations that he/she may be exposed to. As a matter of fact, countries organize protection measures according to their own possibilities and which crimes they prioritize combating. In this study, we will examine the scope of witness protection and witness protection measures in Turkish and Yemeni criminal procedural law in three main sections. In the first section, we will focus on the concept of witness, the definition of witness, and the rights and obligations of the witness. In the second section, the protection of witnesses in Turkish criminal procedure law will be discussed, and in the third section, witness protection in Yemeni criminal procedure law will be discussed. In the second and third sections, the scope of protection will be examined first, and then witness protection measures will be given under two headings as procedural and material measures. Within the scope of the study, various views in the doctrine will be included through literature review, and our own views and suggestions regarding these will be stated in the fourth section.
