Misdemeanors and crimes Of smuggling in the perspective Of "Struggle Aganist Smuggling Law- Number:5607"

Smuggling is a widespread position among many of the crimes in Turkey.Smuggling is a reality for many centuries. "Struggle Aganist Smuggling Law -Number.4926" which abrogate "Smuggling Disqualifiacation and Pursuit Law -Number:1918", brought many innovations in the law system of smuggling in Turkey. But, the criminal code was abrogated because of the new criminal code.This new criminal code changed nearly all of the crime system in Turkey and the "Criminal Procedure Code" was changed and the first contravention law in Turkey " "Contraventions law" (Disdemeanors law) was made, according to modern idea for seperating crimes and disdemeanors. Because of these new Codes and laws, the lawmaker considered the necessity of making new smuggling law. But the mentality of this new law (Struggle Aganist Smuggling Law- Number:5607) is more different than the old law.Modern Idea of Economical Punishment for Economical Crimes is abandoned. Like the Law No:1918, imprisonment is accepted for all crimes (felonies) of smuggling. The punishment of crimes (felonies) and misdemeanors (contraventions) of smuggling is different, because of the Contraventions Law.There is a imprisonment and judicial fine for all crimes of smuggling, and there are only administrative fines for contraventions. Neverthless, in smuggling law,there are some contradictions aganist criminal code and Contraventions law.
