Abstract (EN)

This thesis examines the arbitration systems of commodity unions in the UK, which led to the emergence of the concept of commodity arbitration, and firstly examines the difference of the concept of commodity arbitration from general commercial arbitration and the background of these associations to become centers in the field of commodity trading. In this context, the arbitration system of each commodity union, in particular the Grain and Feed Trade Association, is explained in detail. After discussing the prohibition of representation with the attorney included in the rules of the Union, the procedure for the enforcement of the arbitration decisions of commodity unions, which are accepted as foreign arbitration decisions in accordance with Turkish arbitration legislation, and some high judicial decisions in In the last chapter, Turkey's established regarding certain agricultural products that take the lead in cultivating and exporting roots dating back to the early 20th century "agricultural sales cooperatives unions" of a similar commodity union status and opportunities of attaining recognition in the UK, especially the Turkish legal system and institutions providing arbitration services in Turkey are discussed in perspective. As a result, it was determined that the success of such an undertaking depends on the provision of an arbitration service within the framework of commercial and ethical rules and arbitration rules regulating the trade of the related commodity on the one hand, and on the other hand, in some respects to make the Turkish arbitration legislation more appropriate to the nature and requirements of international trade.
