Independent administrative authorities in Turkey and public procurement institution as a model

Abstract (EN)
With the changing economic, political and social circumstances in 1970?s, thestructure, functions and role of public administration is started to be questioned inmost of the countries, the social state comprehension has got into a purificationprocess and a transition through neo-liberal politics has aroused. In this sense, marketeconomy has become widespread in developed and developing countries and therehas been some changes in public services in accordance with the affects ofglobalization. Regarding the expression of making the interruption of the state to theeconomy minimum; states have drew back from their roles and right after thatintense privatization transactions has been aroused. After those privatizations in mostof the fields that the government draws back-especially in the sensitive sectors ofthe economy which are banking, capital market, competition etc.- some problemshave been occurred because of the natural monopoly structure of those fields and theduty of taking care of those problems is assigned to the government. The governmenthas now taken the responsibility and duty of regulation and auditing to preventproblems in the market in those sensitive sectors. And this duty is being implementedby those institutions which we call The Independent Administrative Authorities.The Independent Administrative Authorities which established in late 1800?sin USA, has been widespread parallel with intense privatization in Europeancountries as well. In Turkey, those institutions has started to found in accordancewith the liberalization and privatization transactions that started after the 24 January1980 decisions which is a landmark for our country and spread around in 1990?s.Nowadays, the nine examples of Independent Administrative Authorities in Turkeydiffer from classical public institutions by their structural and functionalcharacteristics.In our country, Independent Administrative Authorities are financiallyand administratively autonomous public corporations which are established by thelaws legislated by the parliament, implement regulations in some sectors and performtheir activities within the independence given to them. Turkey has not been able toget the benefit it expects form Independent Administrative Authorities until now for353they differ from each other in may ways and established in a false sense. In thatsense they have to be reformed so that they can do what they ought to for theeconomy and development of the country.One of the Independent Administrative Authorities in our country is ThePublic Procurement Institution. The institution has been established in 2002 after thereform studies in public purchase system and collimation of international institutionslike EU, IMF, World Bank. The Public Procurement Institution as a generalregulatory is a financially and administratively autonomous public corporation whichperforms regulation and auditing in all related sectors in accordance with theindependence given to him by the organic law. That institution which has asignificant place in economy is essential for our country according to its workingorders at Turkish procurement system.
