Legal characteristics and judicial monitoring of The Standing Orders of The Grand National Assembly of Turkey

This study discusses the legal characteristic, historical process, place in hierarchy of norms, applications by the Assembly and monitoring of those by The Constitutional Court, of The Standing Orders of The Grand National Assembly of Turkey within the context of doctrinal approach and personal view.Parliamentary law is a constantly evolving branch of law. As a source of parliamentary law, standing orders come into prominence with regard to their quality of effecting politics.Working procedures and principles of the assemblies in Turkey are regulated by the Constitution, Standing Orders and a variety of laws. Except these written, not only the decisions of The Constitutional Court and doctrine but also parliamentary applications have become important sources formalizing Turkish parliamentary law in consequence of their transformation into judicial customs over time.Decisions of The Constitutional Court are effective in forming both the applications of the assemblies and laws. Whether limited, The Constitutional Court has the competence of monitoring parliamentary decisions considered as amendment in standing orders through action on account to the fact that they have the same judicial effect with The Standing Orders. Thus, The High Court monitors the parliamentary decisions mentioned, referring to its competence devoiding of a constitutional ground.Through monitoring, The High Court, on the other hand effects the politics. The High Court?s interpretations of written rules, different decisions in similar cases and equivocal explanatory statements become the focus of debate from time to time.Key words1. Parliament2.
