Abstract (EN)

Public purchases are used as an important tool in the activities carried out by the state. Public administrations must purchase goods and services to perform the tasks that are assigned on them. The appropriations that are necessary for the provision of public goods and services and the budgets of public administrations must be spent in accordance with the principles and rules contained in the legal legislation. Today, an important issue in the context of expenditures made by public administrations is whether transparency, which is considered as one of the basic principles of public procurement legislation, is achieved during the public goods and services process. With the entry into force of the Public Procurement Law No. 4734 in 2003, many new regulations regarding the establishment of transparency in the procurement of goods and services have been put into practice. These regulations aim to increase transparency, efficiency and productivity in the tender process. The more knowledgeable the bidders will be able to prepare such good proposals for the tenders; The prepared proposals will also allow for better quality and reasonable prices to be purchased for goods and services. With the establishment of transparency, public procurement will be conducted in a fair and equitable manner before the tender, during the tender and after the tender, and the trust environment will be formed. It is very important to maintain efficiency, economic stability and to provide this trust for individuals who will use the goods and services purchased and tenderers who will take part in the tender. The aim of the study was to ensure that in the Turkish public procurement system, in the process of supplying the goods and services taken to the establishment of State activities, the legislation which is in force in the provision of transparency among the fundamental principles Determination of the arrangements and the effects of these arrangements in the application are embodied by example dispute resolution.
