In this study named ?An Evaluation on the Legal Regulations Restricting Freedom of Broadcasting in Turkey?, answers are being sought for the questions the philosophic bases of the freedom of broadcasting, what are the legal regulations restricting the radio-TV freedom in Turkey, which changes have been made periodically with the regulations made, and the way of the freedom of publishing being affected by periodical conditions of Turkey. Answering of these questions is important as they investigate the legal variations restricting the radio-TV broadcasting of a country, and also it is a comparative study between the periods. When answers are sought for the study questions, changes of constitution were taken as the measure and periods were determined accordingly with the expectation that this will bring ease in terms of work, operation, and comparison. This classification was made considering the principles stated in constitutions would determine the quality of the laws regulating the broadcasting of radio-TV. The main characteristics of the economic policies and political transformation foci in Turkey were examined, and were evaluated in the context of the philosophic bases of this freedom in the World and in Turkey. Constitution was changed two times in Turkey after the commencement of radio broadcasts in Turkey. First of these was the Constitution of 1961, and the other is the Constitution of 1982. The subject matter of the study was attempted to be explained and interpreted by considering that the principles stated in the constitutions would determine the laws. Each period was compared to the previous one by examining the economical policies and political transformation foci, and by finding out the effective actors on the changes in this scope. Evaluation of the legal regulations restricting the freedom of publishing was performed according to the philosophic bases of this freedom both in the world and in Turkey. Since this study with the quality of an establishment of the situation is based on the review of the existing knowledge in the field, it is performed using literature review and synthesis method. The philosophic bases of the freedom of publishing in Turkey have their roots in the westernizing process of the Ottoman Empire in the nineteenth century. In this process, freedoms, and the freedom of expression and press in this context, gained importance as a part of the democratizing; however, development of these was kept under the pressure of the government right from the start. When Turkish Republic is the subject, the philosophic bases of the freedom of publishing were again perceived as a part of the objective of integrating with the Western World. Together with this, freedom of publishing in Turkey was formed according to the wishes and interests of the political parties, and was determined by the military coups that confiscated the management of the country as a result of the social and political dynamics. Lastly, the fact that the targeted changes cannot be ensured by putting radical prohibitions with legal regulations restricting the freedom of publishing is stated, and it is emphasized that the problems of the legal restrictions regarding publishing should be evaluated independently from more comprehensive social problems.
