Abstract (EN)
Medical intervention shall be defined as physical and mental practices which implemented by people who are authorized to execute medical profession, in order to provide, protect and enhance medical prosperity of someone, in respect of the principles and rules of medical science. Consent to medical intervention refers to use of a strict personal right and justify the medical intervention as a rule. Consent should be given after necessary information is taken before the medical intervention and remain until the end of the practices. Medical interventions are not always physically and mentally beneficial to person whom the intervention is implemented and some medical interventions provide benefit to third parties. On behalf of consents to medical interventions for third party beneficiaries, legislative power enacted some special statutes. In this context, organ and tissue transplantations are special types of medical interventions and as they provide benefit to third parties, issue of consent shows specialty. Also third party consents to medical interventions of people who do not have capacity to consent may be examined under this context.
