Relations between the International Criminal Court and Africa

The International Criminal Court was established by theTreaty of Rome concluded on July 17, 1998 and enters edin to force on July 1, 2002. This international jurisdiction is responsible for punishing the perpetrators of the most serious international crimes in order to participate as far as possible in themaintenance of international peace and security. Since its establishment, it has been very active in the fight against impunity in Africa. It was thent hat it benefited from the cooperation of African States, which did not hesitate to refertonational situations to it sothat it could prosecute the alleged perpetrators of crimes within its jurisdiction. However, at present, relations between the ICC and Africa have deteriorated to the point that the African Union is offering a palliative by setting up an African Criminal Court. The objective of this study is to show that if the ICC has been perceived as an instrument in the fight against impunity, the factremains that in Africa today; it is seen as an instrument of judicial imperialism.In this regard we will try to begin in the first part, the general presentation of the international criminal court and in the second part, we will try to develop the relations between the ICC andAfrica and finally we will conclude on metacritique.
