International Criminal Court and Nagorno-Karabakh

Having occupied Nagorno-Karabakh (NK) and its environs for nearly 30 years, Armenia attacks on Azerbaijiani civilian settlements as a provocation, on the one hand, while manipulating all the peaceful solutions to reclaim the lands, revealed that the II Nagorno-Karabakh (NK) war was inevitable has put it. The II NK war, which started with the attack of Azerbaijan in response to Armenia's attacks on civilian settlements belonging to Azerbaijian again on September 27, 2020 ended on November 10, 2020 with the ceasefire agreement signed between Russia-Azerbaijian- Armenia States. There have been attacks on the civilian population by the Armenia Armed Forces (AAF) on combatants. As a result of these attacks more than 100 people lost their lives and more than 400 people were injured. With AAF these offensive actions the IHC committed various war crimes by violating the provisions of the 1949 Geneva Conventions (GC) and the Additional Protocol and Rome Statute (RS). In the doctrine, from the first day of the aforementioned crimes, the existing trial options related to the crime cases have been the subject of evaluation in order to ensure justice and punish those responsible, and various opinions have been put forward by emphasizing the necessity of the case to be tried by the International Criminal Court (ICC) in order to make a fairer and more probable trial. In this study, it is aimed to evaluate the possibility of the criminal events committed by the AAF during the II NK war, to be tried by the ICC by giving examples from the cases that are the subject of the case before the ICC.
