Abstract (EN)

Air travel is by far the safest and fastest form of transport. The Warsaw Convention as amended by the Hague Protocol and Montreal Convention establish air carrier's liability in cases of delay, damage or loss of cargo in international air carriage. My thesis aims to answer many essential questions for the application of the Warsaw Convention as amended by the Hague Protocol and Montreal Convention in Turkey regarding carriage of cargo by an air carrier in a detailed way. The present study evaluates liability of the air carrier in international cargo carriage by air and the scope of such liability. The present study concentrates on problematic aspects of both the Warsaw Convention as amended by the Hague Protocol and the Montreal Convention in Turkey by discussing decisions of the Turkish Supreme Court and various court decisions from other jurisdictions. In the light of the main Turkish Law principles, opinions advanced by scholars and decisions of the Turkish Supreme Court as well as of foreign courts regarding the Warsaw Convention as amended by the Hague Protocol and the Montreal Convention, my thesis aims to reach a workable solution for the problems analyzed.
