The place of financial leasing agreement in international law systems

In this study, "The Influence of the Anglo-Saxon Legal System and the Continental European Legal System on Financial Lease Agreement"; is discussed and reviewed. Even though the financial leasing system is an area that has emerged for economic reasons, it has taken its place in the legal system in a short time. Many grounds have influenced these legal regulations. International trade routes, economic and welfare conditions, industrial and technological developments, and adopted legal systems are among primary factors altering the development and structure of the financial leasing agreement from one country to other. In this regard, the Anglo-Saxon Legal System and the difference depending on the Continental European Legal System constitute is the research area of the current study. This study consists of four chapters. The first chapter discusses the birth of the financial leasing contract, its acceptance in the legal system and the legal dimension of financial leasing. Thus, the general principles regarding the establishment of the financial leasing agreement are included. In the second chapter, the rights and obligations of the financial leasing agreement to the parties are evaluated comprehensively. Thus, upon understanding its historical development in the first chapter, the second chapter presents the rights and obligations defined by the financial leasing agreement. Possible disputes regarding the financial leasing relationships are stated. The third chapter of this study discusses conditions for the termination of the financial leasing agreement, and its terms and potential results. Eventually, the legal process from the beginning to the end of a financial leasing agreement is evaluated in general terms. In chapter four, which is the final chapter of the current study, the impact of legal regulations based on countries' legal systems on the development of a financial leasing contract, and its relationship with the economic gain of countries are discussed.
