International law and politics relations: The interventions of USA in the context of the progressive approach

The matter of how the relationship between law and politics should be has formed the topics of various philosophers' studies. Normative thoughts occupy an important position in this regard. In this thesis, initially, normative theories have been described and the thoughts of the related philosophers about law and politics have been handled. The opportunities for building a fair peace with international law have been handled within the context of various critical approaches such as Two Rhetorics, Third World Approaches to International Law (TWAIL) and Progressive Approach. Progressive Approach, especially, offers a rich content because it consists of various thoughts. Putting forward the principle of the rule of law and providing concrete solutions to concrete events, the Progressive Approach, today, has been considered as the most suitable approach to describe international law and politics relation and to solve the problems faced in international system. The US intervention in the post–9/11 period was evaluated in the context of international law and politics. In the United States, it has been revealed that in the interests of politics, international law has prioritized power, but if it fails to do so, it tries to reach its interests by using force. Thus, the necessary conditions for the reconstruction of international law in the context of Progressive Approach and the establishment of a universal peace were evaluated legally and politically in accordance with the purpose of the study.
