The impact of developments in international law on fundamental rights and freedoms in Türkiye

This study examines the impact of developments in international law on fundamental rights and freedoms in Turkey. International law plays a significant role in the protection of human rights and fundamental freedoms through organizations such as the United Nations (UN) and the Council of Europe (CoE). Instruments such as the European Convention on Human Rights (ECHR) and the United Nations Universal Declaration of Human Rights (UDHR) have led to the adoption of measures aimed at safeguarding fundamental rights within Turkey's domestic law. Fundamental rights and freedoms can be defined as inherent rights that human beings possess from birth and constitute one of the most important subjects of legal systems. Events that have occurred throughout the historical process have increased interest in this matter and reinforced the notion that these rights must be protected. The enforceability of violation judgments rendered by the ECtHR concerning Turkey has been a significant issue generating controversy. These controversies are of great importance in terms of Turkey's development in international law and its integration process with Europe. Furthermore, the implementation of regulations compatible with ECHR provisions in domestic law during Turkey's European Union (EU) accession process and the effects of constitutional amendments on this process must be examined. The consideration of ECtHR judgments as precedents in national judicial proceedings will contribute to Turkey's achievement of positive outcomes in terms of international law.
