Criticism of assisted reproduction techniques in international texts from a feminist perspective

Assisted reproduction techniques have developed rapidly in the last four decades with scientific advances. Assisted reproduction techniques has reached a cross-border dimension due to globalization, social order and gender transformations. Government policies on assisted reproduction techniques are generally prohibition, inertia and status regulation. The issue of reproductive and family relations bears the traces of nation-building and social policies of government. Because assisted reproductive techniques are related to the issues that are generally accepted as the domestic legal order of the states such as family relations, filiation, nationality and citizenship. However, different practices in different countries have created an international legal gap for reproductive technologies. Therefore, international coordination is necessary for the uniformity of the practices. In this context, in this thesis first of all, general information about assisted reproduction techniques is given; then, international texts have been examined for the solution of legal problems arising from conflicting legal regulations of states. Finally, the status of women in the international legal gap and their current and potential problems will be discussed within the framework of feminist theories.
