Cooperation in the recovery of maintenance regarding the children in private international law

Abstract (EN)

Taking necessary precautions for the protection and care of children and giving importance to their education play a major role in their upbringing as healthy individuals. As a result of migration movements caused by increasing transportation and communication opportunities in the developing world order, it has become difficult to meet the needs of children who are away from their parents. For this reason, states have signed international conventions for international recovery of maintenance for children and facilitated the international recovery of maintenance receivables. In this context, Convention of 23 November 2007 on the International Recovery of Child Support and Other Forms of Family Maintenance, which envisages a contemporary, low-cost and rapid maintenance recovery system and is based on an international administrative cooperation system, has been appointed to replace the previous dated international conventions that have been contracted on this issue. In this study, the administrative cooperation system in the international recovery of child support is examined within the framework of the provisions of the Convention of 23 November 2007 on the International Recovery of Child Support and Other Forms of Family Maintenance. In this context, the child and maintenance concepts will be emphasized. The child support requests for children included in Turkish Law will be examined. Then, the features of the New York Convention of 20 June 1956 on the Recovery Abroad of Maintenance and the Convention of 23 November 2007 on the International Recovery of Child Support and Other Forms of Family Maintenance, which are among the international agreements that are organized and which are parties to the international recovery of child support will be included. In the next part of our study, the applications for international recovery of child support for children will be evaluated within the framework of the provisions of the Convention of 23 November 2007 on the International Recovery of Child Support and Other Forms of Family Maintenance.
