Abstract (EN)
The focus of this research is to analyze the concept of the misuse of rights within the field of international arbitration law. While the theoretical dimension of the abuse of rights is addressed, its emergence in comparative law is investigated, issues related to its application in different legal systems and regional contexts are discussed, and reflections of the principle in the field of international arbitration are analyzed. This research highlights the growing recognition of the significance of the abuse of rights principle in the practice of international arbitration. It evaluates the potential impacts of the principle in terms of the effective management of arbitration processes, balancing party interests, and the legitimacy of the arbitration process.
