Abstract (EN)
The purpose of this study that we named as "Damage Assesment in Internetional Arbitration" was the detailed overview of the concepts, basic principles, national and international regulations under the light of internatonal arbitration awards. The instituiton of "Damage Assesment" could very scarcely be framed in both national and international sources, in terms of commercial and investment arbitration, since the disputes could vary in a dozen scenarios as a results of contractual breach or wrongful act. In the scope of emerging arbitration jurisdiction with the perspective of Turkish Law, we tried to explain the concepts inherint in international arbitration implementations arised from both Common law and Civil Law.
