Abstract (EN)

The circumstances that would adversely affect the order of institution from the point of public law lead to issues in the public service. The main purpose of the disciplinary law is to ensure the institutional order. In order to realize this aim, various disciplinary rules are envisaged by making separations based on institutions and professions. These rules for discipline constitute different disciplinary systems. The body of rules set by the universities for the purpose of providing and maintaining the order of institution constitute the disciplinary system in universities. Disciplinary rules are mainly implemented towards those who are responsible for public service. However, in some cases, those who benefit from the public service, which is closely linked to the existence of the service, are also included in the scope of the disciplinary law. Those who is responsible for the public service and those who benefit from the public service are obliged to obey the institutional order of the university in the universities. In this context, people who are responsible for public service in universities consist of academic staff and administrative staff. Students benefit from public service and are subject to disciplinary system. Students directly relate with the educational public services in universities. Disciplinary system in universities; aims to protect the order of the institution with rules which based on academic staff, administrative staff and students. These distinctions based on people form sub-disciplinary systems. In our study, the disciplinary system in universities is tried to be explained with person-based distinctions and judicial decisions. This study also includes examples of decisions of the European Court of Human Rights and Turkish Constitutional Court about disciplinary law.
