Abstract (EN)

Narcotic and stimulant substances have become a rapidly increasing threat to human health from past to present. The definition of narcotic drugs in the World Health Organization includes "substances that create an irrepressible need or desire or a tendency to increase the amount used, psychological and physical effects, based on the effect they have on the person." The World Health Organization Expert Committee has grouped addiction types under 10 headings. These; They are divided into groups as "alcohol, caffeine, marijuana, hallucinogens, inhalants, opiates, sedative-hypnotics, stimulants, nicotine and other newly produced products." In this study, separate legal regulations regarding the use and trade of drugs and stimulants, as included in the crime definition, and whether there are similarities in terms of education level, age, gender and some profile characteristics of those convicted of these crimes were investigated. The data prepared by the Turkish Statistical Institute is our source data. The subject of our research is the prisoners who were tried and convicted in the High Criminal Courts authorized in Çorum province. Comparison of the crime of use or trafficking of narcotic and stimulant substances and the crime for which the defendants convicted of these crimes were punished, the types of substances subject to the crime, duration of addiction, educational status, profession, age, gender and marital status were investigated and evaluated in terms of Forensic Sciences. Data presented according to the profile characteristics obtained as a result of the study; We believe that it will contribute to the definition of crime and the resolution of disputes regarding the purpose for which the perpetrator possesses drugs, and that it produces useful findings in order to protect the defendant's right to a fair trial by being tried within a reasonable time and to make a positive contribution to the implementation of the principle of investigating the material truth by the courts.
