Abstract (EN)
The subject of our study is the crime of "Inciting The Use of Narcotics or Psychotropic Substances " regulated in Article 190/2 of the Turkish Criminal Code. As a product of the effort to fight against illicit drugs required by the national and international crime policy, this crime has regulated in our domestic law and in the domestic laws of some other countries. This study primarily focuses how this crime and similar crimes are regulated in selected countries. Then, legally protective value of this crime and elements of it are explained and culpability, special appearance forms of crime, sanctions and rules of criminal procedure are examined.
