Abstract (EN)

The testamentary disposition is a legal action that includes the instructions that will come into effect with the death of the testator. How and in what way the will of death will be expressed is expressed in the formal sense with the concept of disposition related to death. In the material sense, with the concept of death-related savings, the wishes and wishes of the deceased, that is, the content of the death-related savings are expressed. In Turkish Law, there are two types of testamentary disposition, namely testamentary and inheritance contract. If the inheritor has chosen the way of will to explain his wishes, wishes and orders that he wishes to be implemented after his death, he will be able to make his will only in an official, handwritten and verbal form, since the principle of limited number is valid. In this context, in the first part of our thesis, the concept of death-related savings and its types are briefly discussed. Since the will is a testamentary disposition, the will to enter into force will be valid with the death of the issuer. The concept of a will entering into force and being effective and the gain of the beneficiary of the will do not mean the same thing. In this context, it is important for the testator to know the characteristics and conditions of the will. For this reason, the second part of our study constitutes the basis of our thesis, where the entry into force of the will, the acquisition of the right of will by the heir appointed by the will or the person in whose favor the will is made are examined. In the third part of our thesis, the cases of non-enforcement of the will, the case of criticism and the case of annulment of the will are examined.
