Abstract (EN)
This study examines the work of the European Commission for Democracy through Law,commonly known as the Venice Commission, the Council of Europe's advisory body on constitutional matters, in the context of its contribution to liberal constitutionalism. Initially established as an advisory organ to assist in transforming the constitutional systems of former Eastern Bloc countries in line with the principles of liberal constitutionalism, the Venice Commission has expanded its scope and influence to acquire a global dimension. In this capacity, it plays a significant role in articulating common standards of liberal constitutionalism at the global level. The first section of the study outlines the concept of liberal constitutionalism, its core principles, historical evolution, and international character. The second section examines the historical background in which the Venice Commission emerged, as well as its institutional structure and working methods. It further evaluates the Commission's various activities and their legal and political impact particularly on the European Court of Human Rights, and more broadly on political bodies such as the European Union and the Council of Europe. The final section analyzes the standards developed by the Venice Commission through its transnational activities and the opinions it has issued on individual countries, focusing on the rule of law, elections, referendums, political parties, the separation of powers, and judicial independence.
