The crime of unlawful delivery or acquisition of data (TPC article no. 136)

The concept of personal data, which is expressed as all kinds of information that makes the individual identifiable, is significant, especially due to the protection of the individual before the legal order in the presence of global technological developments. This concept, whose application area has expanded with the international and national regulations made in recent years, is also significant in terms of Turkish Law. The concept of personal data, which entered into force in 2005 for the first time in the national sense and has been taken under protection with the types of crime regulated in the Turkish Penal Code No.5237, became determinable and secured with The Law on the Protection of Personal Dаta No.6698, which wаs enacted in 2016 and is a general data protection law. Our research consists of two chapters. In the first chapter, the concept of personal data, the nature of the right to protect personal data, the development of personal data protection law and the regulation ways both in international and national resources are discussed. In the second chapter, the definition, elements, special appearance types and sanction and judgment of "The Crime of Unlawful Delivery or Acquisition of Data" regulated in Turkish Penal Code Article No.136 are discussed.
