Abstract (EN)
The crime of perjury, which is regulated as a deterrent force in order to ensure the reliability of witness evidence, which is one of the oldest evidence of the trial, and to ensure that justice is delivered safely to the courthouse, is regulated in Article 272 of the Turkish Penal Code No. 5237. In addition to this regulation, Article 273 regulates the reasons for the crime that require personal impunity or reduced punishment, and Article 274 regulates the situations of effective regret. In order for the offence to occur, it does not matter whether the statement of the witness affects the judgement or not and whether the witness has given an oath or not. However, in order for the basic form of the offence to occur, the witness must have given his/her statement in front of the person or committee authorised to hear witnesses within the scope of an investigation initiated due to an unlawful act. The offence is one of the specific offences since it is an offence that can be committed by persons who have the title of witness.
