Artificial intelligence and criminal responsibility

Artificial Intelligence is an important issue of our time, revealed by human creativity. The integration and use of Artificial Intelligence is widespread in various areas of life, including society. The impact of Artificial Intelligence is multifaceted and encompasses both positive and negative consequences. While Artificial Intelligence offers benefits to the field of law, it also brings challenges that need to be addressed. These challenges include possible risks, dangers, and harm to individuals and society as well as the possibility of violations of fundamental rights and legal principles. Additionally, the ability of Artificial Intelligence to commit crimes raises questions about the responsibilities of individuals and organizations involved in its development and deployment. Criminal law must consider these issues and determine the scope of the duty of care and attention in artificial Intelligence. The extent to which permissible risk affects human liability and whether different types of liability should be identified should also be considered. It is not yet known whether the actions of artificial Intelligence can be considered a crime or whether it can directly commit a crime. The key point in solving these problems is determined by the legal perspective on Artificial Intelligence. The positioning of artificial Intelligence by law, the legal status it will have, the meaning and consequences to be attributed to the effects of Artificial Intelligence, and the issues of liability and sanctions will be directly determined. In this respect, we can say that the law and criminal law's perspective on Artificial Intelligence, which will frequently encounter problems related to artificial Intelligence in the coming period, will also determine the answers. In short, criminal law plays an important role in solving problems related to Artificial Intelligence. In our thesis "Artificial Intelligence and Criminal Liability" we will examine various criminal law concepts and institutions, such as principles of responsibility, theories of responsibility, elements of crime, and culpability, and propose solutions and hypotheses for these legal problems.
