Judicial ombudsmanship and its feasebility in Turkey: A model proposal

Abstract (EN)

Various problems surround the functioning of judicial bodies in the world and in Turkey. In the spirit of reform, many countries have been passing regulations to resolve these problems. Ombudsman supervision is one such regulation. Although the legal work of judicial bodies is not within the terrain of ombudsman, the role of ombudsman supervision is important for resolving problems deriving from the functioning of the judiciary. Ombudsmanship involves various lines of expertise and legal ombudsmanship has various functions such as preventing maladministration in the judiciary system without harming the independence and neutrality of judiciary bodies, and maintaining accountability. The subject of the research is to examine the judicial ombudsman through country examples and to propose a model for Turkey. The goal of this research is to theoretically analyze the system of judicial ombudsmanship and country examples, and further develop model proposals. The concept of ombudsmanship and its features, its classification, and implementation examples have been analyzed. The features of judicial ombudsmanship have also been considered through an investigation of expertise ombudsmanship. The structure and functioning of Ombudsman Institution (OI) has been analyzed in terms of the operations of judiciary bodies. The benefits of the founding of a judicial ombudsmanship in Turkey has been featured. Models have been exemplified and these model examples have been used to propose the founding of a judicial ombudsmanship. The research has benefited from document analysis technique as a qualitative research method and descriptive research method in interpreting data. A literature review for Turkish and international sources has been conducted. The research has been written by using indirect and citation research method.
