Abstract (EN)
In this article legal fees of which arising from the attorney agreement between the attorney and client and are considered as litigation expenses within the scope of procedural law and other litigation expenses have been evaluated. Attorneyship is one of the constitutes of the trivet of the judiciary system and provides professional legal support within the scope of utilization of right of defense. It is imperative for an attorney to practice the legal profession in exchange for a price due to the professional knowledge the attorney employs. Legal fees arising from the attorneyship agreement as well as the procedural law are among the prominent subjects in attorneyship law given the ban on free-of-charge counseling. In the first section of this article, "attorneyship fee", attorneyship agreement and attorney's right to charge have been examined. In the second section, litigation fee and expenses, attorney's fee as a litigation fee and the concept of which party is bearing the legal costs as well as the impact of the principles of procedural law over the litigation costs have been illustrated. Also, the Turkish Constitutional Court's approach towards Article 164 of the Attorneyship Law numbered 1136 and legal fees arising from the procedural law has been discussed.
