Giving custody according to the Superme Court decisions on custody cases taking the child's opinion during the court

The subject of this study is " Giving Custody According to the Superme Court Decisions on Custody Cases and Taking The Child's Opinion During The Court". İn Turkish Civil Code, custody regulated in Article 335- 351. Custody cases are one of the most important arrangement related to the child. İn our study, custody cases were reviewed with the relevent Supreme Court judgments. İn accordance with the constitution and international conventions, the child at the age of discernment should be included in the process and the child's opinion must be taken during the custody cases. In our study the age of discernment, the method of interview with the child, the balance between the child's best interests and taking his/her opinion, and the discretion of the judge on custody have been emphasized.
