Abstract (EN)
Ensuring a healthy life can only be sustained by avoiding environmental destruction. The environment is the shared habitat of human being and all other living organisms. For this reason, living in a healthy and balanced environment is one of our fundamental rights. The rise of environmental issues at the global scale has motivated the vitality of environmental law. Becoming one of our most fundamental rights, environmental law has effectively been argued. Various legislations were reinforced soon after the environmental law was enacted in our country. Never the less, the volume of environmental problems and concerns are continuing to increase. In addition to legal and compensation sanctions, criminal sanctions are imposed to avert rising environmental problems. These sanctions are introduced to guarantee environmental protection. By resolving disputes, the judicial authorities contribute to environmental protection with their decisions. Ensuring faster and more accurate decisions would lead the environment to be protected more effectively. It is understood from the Supreme Court decisions that individuals and entities have harmed the environment directly or indirectly. The Local courts and the Supreme Court have given agreeing decisions regarding environmental protection through legislation. It is observed from the Supreme Court rulings that the environmental protection is prioritized. However, due to the insufficient punishment levels and the insufficiency of the decision's execution, the creditability of the idea to protect environment through courtd ecisions is negatively affected.
