Equalization payment in statutory property regime

This postgraduate thesis entitled the ?Equalization Payment in Statutory Property Regime? consists of three main parts. The first part mainly concerns the property regime and property regime models. It then describes statutory property regime, the general provisions related to the statutory property regime and governing principles of the statutory property regime. Finally, it explains the optional property regime under the titles ?property regime contracts? and ?types of optional property regime?.The second part examines the topic of equalization payment in the statutory property regime, which constitutes the essence of this work. For a better understanding, this detailed review primarily addresses the acquired and personal under the statutory property regime under the titles of acquired property and personal property, by taking account of relevant legislation and various approaches in the doctrine. This part then elaborates on equalization payment under the titles of classical equalization payment, variable equalization payment, equalization payment in case of gratuitous acquisition, comparison of equalization payment with appreciation rate and allocation of debts to asset groups, in view of existing legislation, case-law of the Court of Cassation and various approaches in the doctrine.The final part deals with the general provisions related to the equalization payment and particular circumstances related to equalization payment, by taking account of relevant legislation, case-law of the Court of Cassation and various approaches in the doctrine.
