Abstract (EN)

It consists of two institutions that complement each other: legislative immunity, legislative irresponsibility and legislative inviolability, which enables members of parliament to carry out their legislative activities without fear of all kinds of pressures and threats.Legislative immunity protects lawmakers' statements of opinion, speeches and votes related to parliamentary work while trying to prevent members of parliament from being detained on arbitrary and unfounded criminal charges. Soway, the national will is fully manifested in the parliament. Legislative irresponsibility in paragraph 1 of Article 83 of the 1982 constitution allows lawmakers who are representatives of the nation to fearlessly oversee the executive. Because it is only possible to express the flaws, omissions and violations related to the government's actions without concern for investigation and prosecution, only with strong protection of freedom of expression. In this study, the general characteristics of legislative irresponsibility were determined and the historical process in our country and comparative law was discussed, and then the characteristics of the institution were examined together with exemplary judicial decisions in the context of freedom of expression.
