A new conception of the earth: Ecological constitutionalism

The subject of the thesis is to examine whether it is possible to design a new world by using the method of constitutionalism in the face of the ecological crisis, which has become a global problem today. In the study, first of all, the crisis itself was defined and the factors that led to its emergence and exacerbated the problem were examined. Then, it is explained whether these solutions offered by the current anthropocentric legal system to the ecological crisis have been successful or not. Finally, the effect of the constitutions and court decisions has been revealed by an ecocentric view on the design of the earth. The aim of the study is to show that today's human-centered legal perspective reproduces the ecological crisis and to show that we can stop this global problem with eco-centered approaches. In this regard, the limitations and inadequacy of constitutions and international documents which are the products of liberal thought are highlighted. The constitutions of Ecuador, Bolivia and various court decisions of other countries have been evaluated for an alternative legal system that centers on nature. As a result, it is aimed to determine the framework that provides contracting with nature that can be articulated in the constitutions, which are also described as social contracts.
