The Control of administration and local goverment ombudsman

Dr. Arif ErençinDecember 2005, 111 pagesNew ways of control are invented due to the geographically andfunctionally enlargement of administration. The establishment and extension of theinstutition of Ombudsman is one of the results of this development. This institutionisn?t an alternative for other control mechanisms, but it seems as a contributer toovercome inadequancies of control. Ombudsman is an institution as independent asa judge, less formalist, working faster, who enters the management easily, whoconducts concrete and personal investigation on exercise of administrative functions. This institution controls and evaluates administration not only in the perspective oflegality but also according to human rights. It exposes and criticizes the limping andfaulty dimensions of administration. Some countries established local ombudsmanbesides national. Turkey observes the impacts of this development. More recently,?The Law on Basic Principles and Reforming Public Administration? which is sentback to the TGNA for further debate by the President and not still ratified, containslocal government ombudsman in article 42. In this study, in the context of control ofadministration and with comparing the implementation of local ombudsman indifferent countries, the results and suggestions on attempts to establish localgovernment ombudsman in Turkey is reviewed.Key Words: control, local government, ombudsman, reform.
