Abstract (EN)
Road transport, the most common form of transport, can always have dangerous consequences due to human and risk factors. In our country, many traffic accidents occur every year and individuals are harmed. Compensation of the damages suffered by individuals by faulty persons is important in terms of compensation law. Within the scope of the tortious acts; persons who harm someone else with a flawed and unlawful act are obliged to repair this damage. Since the traffic accident is basically based on tort responsibility, the person who played a role in the occurrence of the accident and the damage of a third person with his faulty behavior is obliged to eliminate the damage that occurred within the scope of danger responsibility. As a result of the expansion of the concept of responsibility, the concept of ensuring responsibilities has come to the fore. In this context, motor vehicle operators are obliged to take out insurance to cover their liabilities and the damages to be incurred by those who are damaged are covered by an insurance contract. Persons who have been harmed as a result of a traffic accident can claim the damage they suffered from the motor vehicle owners, drivers, or insurer, provided that the damage they suffered is at fault.
