Tetebbu'u'r-Ruhas 'Inde'l-Usûliyyîn

يعتبر هذا البحث مرحلة نحو الأعلى لجمع وتفصيل مسألة هامة من مسائل وأمور المسلمين ألا وهي (تتبع الرخص)، وقد انتهى البحث إلى نتيجة أنه يجوز العمل بالرخص الشرعية لضرورة أو لعذر أو لمشقة غير محتملة في العادة ولا حرج في ذلك، وتقدر المشقة أو الضرورة في العبادات عند المكلف أو مفتيه، ويكفى في أمور المعاملات بأقل المشاق، وقد تكون الرخصة واجبة أو مندوبة أو خلاف الأولى ولا يوجد مانع من تتبع الرخص المذهبية والأخذ بالأيسر والأهون لحاجة أو لضرورة، من غير القصد لتتبع الرخص متعمداً بدون مسوغ لها، شرط أن لا يؤدي ذلك للتلفيق الممنوع في الشرع لعدم احترام الأحكام الشرعية متبعاً لهواه، وأما تتبع الرخص عمداً فهذا ممنوع لمحاولة نقص حكم الحاكم المجتهد، أو الرجوع عن أمر مجمع عليه، فتتبع الرخص جائز للحاجة والضرورة في أحكام الشرع التي بنيت على السماحة واليسر مثل العبادات المحضة غير المالية، وفي المعاملات وأحكامها المبنية على أساس دفع المفاسد وجلب المصالح ورعايتها، شرط ألا يؤدي كل ذلك إلى تقييد دعائم الشرع والقضاء على حكمتها وسياستها لسعادة الجميع في الدارين، وعلى المجتهد أو المفتي أو المقلد الالتزام بالثوابت الشرعية وأحكامه الأساسية، وفي مجال العرف والقياس والمصالح المرسلة وسد الذرائع التي لا تخالف أو تصادم النصوص الشرعية، والعمل بالحديث الصحيح وعدم الخروج عن الإجماع مع عدم التعصب المذهبي. This research represents a step towards gathering and detailing the issue of "following dispensations," which is a significant topic for Muslims. The study concluded that it is permissible to undertake tasks that are authorized by religious dispensations due to legitimacy, excuses, or overwhelming difficulties. The difficulty or necessity in religious practices is something to be determined by the individual or their scholar. The level of difficulty in tasks can be minimal. Dispensations may be necessary, recommended, or not preferred, and the pursuit of religious dispensations should not hinder the practice of ease and relief in cases of need or necessity, provided that religious rulings are not violated and personal desires are not followed. Dispensations should not be pursued unauthorized, as this implies an attempt to undermine the government's rulings or alter the scholar's judgment. Therefore, following dispensations can be done within the context of religious rulings that are built on tolerance and ease, in non-material aspects of worship, and in beneficial actions. However, it must be ensured that the fundamentals and wisdom of religion are not neglected and that the principles or policies of religion are upheld for the happiness of both worlds. The jurist, scholar, or adherent must adhere to the fundamental rulings and principles of religion and take measures and precautions that do not contradict or conflict with religious texts, relying on the authenticity of hadiths and avoiding deviation from the general consensus, while also avoiding sectarian discrimination.
