Abstract (EN)
According to the forensic sciences there is no perfect crime. There may be trace and evidence left after every crime that takes interrogators to the material fact. Basis of the uncovering the material fact by from evidence to the suspect, which is an essential judgement of crime interrogations, is determining the evidences of the judicial case.While crime interrogation, the most important materials, that bring the law enforcement to material fact, are the ones acquired during crime scene investigation. In order to be legal, the evidence found in crime scene, should be acquired due to the legislation in force and in accordance with the law. Till 1 June 2005, in our country, there weren?t any restrictive regulations concerning crime scene works and related biological and physical identification determination. Law enforcement was able to start and run crime scene investigations. They were able to act within the frame of their own initiative concerning the acquired biological evidence. Regarding determination of the physical identification, finger prints of the suspects were able to be taken according to Police Mission and Authority Law. In our legislation there were some legislative regulations done within the EU harmonization process. Generally crime scene related activities took place in our legislation with the Code of Criminal Law and the related regulations. By these legislative regulations, even though the judicial authority of law enforcement authority keeps up, it has to get the permission from the judicial authority.The first and the most important level of crime interrogation is the crime scene investigation, regulation of the legislation is very important in the sense of individual rights and freedom. However those regulations should not hinder judicial processes in order to reach the material fact.Key words: crime scene investigation, interrogation, physical evidence, legislation
