Responsibility limits of the President in terms of the 1982 Constitution act

With the Turkish Constitutional amendments accepted in the referendum dated April 16, 2017, in the Republic of Turkey, the people decided to change the parliamentary system and a new administrative system was adopted. In this new government system, which is defined as the Turkish type of presidential system and called the "Presidential System of Government", the executive power is completely transferred to the presidency and the "dualist" executive body, which has the characteristics of a parliamentary system, has been changed into a "monist" model. The executive authority and the duty in the monist model turned the system completely into a new model by changing the President's legal status, which also caused significant changes in the duties and authorities of the President. It is necessary to examine these changes. In terms of these necessities, to determine the restriction of her/his absolute responsibility that she/he will benefit from while using her/his presidential duties and authorities, also the procedures to be held accountable outside these limits, the area of responsibilities of the authorized people within the framework of different government systems in the first part of our study and in the second part of our study, the political, criminal and legal limits of responsibilities of the President of the Republic within the framework of Turkish constitutional developments will be examined in all its aspects. In the third part of our study, the President's political, criminal and legal responsibility limits will be analyzed together with all the elements of the executive authority within the framework of the constitutional amendments made in the 1982 Constitution Act in 2017.
