Abstract (EN)

Housing and workplace needs are among the most fundamental necessities of humanity. While some meet this need by acquiring property, others fulfil it by using another person's property for a specified fee. The relationship between the property owner and the individual who pays a price for both using and benefiting from the property is referred to as a tenancy relationship. Throughout human history, the topic of tenancy has constantly occupied the agenda. In our country, as well as all around the world, the termination of the contract between the parties involved in the tenancy relationship, namely the landlord and the tenant, gives rise to severe problems. When the rights of the landlord and the tenant arising from the law and the contract are not well understood, unlawful methods can be employed, disrupting the general public order. In this study, we will examine the reasons for terminating residential and non-residential commercial lease agreements, as regulated under the title of "Residential and Non-Residential Commercial Leases" in the Turkish Code of Obligations (6098).
