The rights and obligations of the condominium ownership within the framework of the Floor Ownership Law no 634

Condominium ownership is an important institution today. Condominium Ownership is a type of private property that has been brought as a solution to the problems caused by vertical construction with the increase in urbanization and population density. Today, the importance of this institution has increased due to economic difficulties, migration to cities, housing problems. In terms of the healthy implementation of the condominium institution, which is also accepted in our country, some rights have been given to the condominium owners, while some obligations have been imposed. While some of the rights of the flat owners are related to the place they own alone, the other part is the rights related to the common places and management. The growth experienced with the increase in population and the increasing urbanization at the same rate make it inevitable for the individuals living in this area to experience some problems. In order to solve these problems, the Condominium Ownership Law dated 23.06.1965 and numbered 634 was issued and some rights and obligations were imposed on the owners with this law. These rights and obligations are regulated in the third and fourth sections of the Property Ownership Law. With these sections, on the one hand, the provisions regarding the benefit of the owners from the benefits provided by the property right, on the other hand, the obligations that determine the limits of these rights are regulated. In this study, within the framework of the Condominium Ownership Law and current judicial decisions, what the rights and debts of the floor owners are and under which conditions they are responsible for these rights and debts are examined.
