Abstract (EN)

Located on migration routes throughout the history, Turkey, today serves as home to many foreigners. The reason for the migration of foreigners to Turkey might be to work and live in Turkey or in some difficult conditions foreigners may forced to leave their countries. This foreigners may come to Turkey in order to request for protection. Foreigners coming to our country want to work in our country in order to earn income; but there are some conditions in order to work in Turkey. In particular it should be stated that as a rule, the foreigners who want to work in Turkey has to get a work permit to work in Turkey. Although it is ruled in the Constitution of the Republic of Turkey that working is both a right and liberty, there are some limitations about freedom of labor. Some regulations has been made on the subject of foreigners working in Turkey; however, the Law on Work Permits of Foreigners is now being repealed and the International Labor Law is being applied. Although the Law on Work Permits of Foreigners has been repealed, the Regulation on Work Permits of Foreigners in force because the regulation for the International Labor Law has not been published yet. In our study labor rights of foreigners in Turkey is explained and information on how to apply for work permit is given. In addition, the innovations introduced under the International Labor Law were explained. While explaining the work by the foreigners in Turkey, some Supreme Court decisions are stated in the related places and some issues encountered in practice has been mentioned.
