Abstract (EN)
In the tenders accomplished within the frame of Law No. 4734 aimingcompliance with the European Union legislation on public procurement, liability of thetenderer commences with acquisition of capacity to make a tender, ends withconclusion of the contract.Liability of tenderer towards contracting authority arises from the principle of?culpa in contrahendo?.Although there is no difference between Turkish legislation on publicprocurement and that of European Union as regards commencement of the liability,they differ from each other regarding the results of that liability.
