Abstract (EN)

ABSTRACTHuman rights have become one of the main and shared concerns ofinternational community. This concern developed two protection methods atboth national and international levels in order to recognize and secure humanrights. Hence, human rights had been the core part of both internationaltreaties and constitutions.There are many international agreements to preserve human rights,but the most effective one is ? The European Convention on Human Rights?,which was signed by our country as well.The Convention included judicial audit, and turned the individual intoone of the respectful subjects of international law by allowing him to complainand apply in any case of human rights violation.?The right to life? of the article 2 and ?the right not to be subjected totorture or to inhuman treatment or to punishment? of the article 3 are thefundamental values of democratic societies.The mentioned rights were secured by the article 17 of the TurkishConstitution.The use of force by police is directly related with the rights mentionedabove. In other words, a citizen should not be subjected to excessive force.From this perspective, the issue was analyzed within two sections,The European Convention on Human Rights and the domestic law.At the first section the issue was dealt with our domestic law. In thissense, the section included internal rules regulating the issue, judicialdecisions and academic comments.At the second section the issue was analyzed through the aspect ofThe European Convention on Human Rights. This section contained thearticle 2 and the article 3 of The European Convention on Human Rights,academic comments and the decisions of European Court of Human Rights.At the conclusion part, the proposals were made by assessing theissue.
