European charter of local government autonomy framework provisions act and 5393 numbered City Metropolitan Municipality Law no 5216

The purpose of establishing the council of Europe which is one of the commonEuropean ideal way to creating via strong and autonomous local governments is torealise this ideal. Because local governments are seen as the nearest administrations topublic and have the scale can be realized by democracy and effective government.Created by the Council of the European charter of local government autonomyand autonomous local governments adopted the general framework of principles havebeen drawn. Turkey which is a council member and approved the agreement, to be ableto take place in common european ideal as with other issues in local governmentswithin the European framework should take place with the same principles and needs toshape domestic legislation in this framework. Municipalities in the field of localgovernment in Turkey are based organizations in nature. Considering all this, I believethe creation municipality Law no 5393 and 5216 Metropolitan Municipality Act hascreated an opening in this regard. Despite all this,however, as has already been subjectto the terms of autonomy is difficult to say.This study totally consists of three sections. The first part is related to the localgovernment general concepts, relationship between globalization and local governmentsis explained.In the second part of the European Local Authorities Conditions of Autonomy isexamined in the context of the principle that brought the concept of autonomous localgovernments . In the last chapter historical evolution of Municipalities in Turkey on thecourse and the Autonomy Law No.5216, No. 5393 are examined.
