The responsibility of the owner of building

In accordance with law no. 6098 Turkish Obligations Law, as per the article 69, this arrangement imposes impeccable responsibility on the owner of the building and building work and the owners of usufruct and residence rights. While the owner is solely responsible for the disorder in the construction, the usufruct and residence holders are jointly and jointly responsible for the lack of care. They cannot benefit from proof of salvation. Therefore, this type of responsibility is the aggravated ordinary cause liability. It is a condition that these persons can be released from liability as a result of harm only if the causal link between cause and effect has been broken. In addition, in order to prevent the danger of damage caused by building or construction work; owners, usufruct and residence right owners and third parties with interests may also request the necessary measures to be taken.
