Abstract (EN)

A suretyship contract is a type of contract in which the surety personally undertakes to be responsible for the consequences of the debtor's failure to fulfill his obligation to the creditor. This thesis study focuses on Joint surety, that is a different type of suretyship agreement, in which more than one surety undertakes to be responsible for the same debt, each as a general guarantor for their own share, and as a surety of surety for the other one's share. Under the light of the above mentioned definitions, first part of our study investigates the joint suretyship concept, its types and scope of its responsibilities by refering to the Supreme Court decisions and to the current changes brought by the Turkish Code of Obligations No. 6098 compared to the Code of Obligations No. 818. In the second part, the relationship among the joint suretyship, creditor and debtor is discussed in detail.
