Abstract (EN)

Throughout history, it has been known that all living creatures in nature have constantly been in a relationship with each other. Animals have gained different meanings for humans throughout history. While animals have sometimes played the roles of friends or companions for humans, it has also been determined that they are sometimes part of belief systems. In the present day, known as the modern age, the rate of pet ownership by humans is increasing day by day. Pet ownership has various roles in the social, psychological, and emotional aspects of human life. The use of animals for therapeutic purposes today, such as reducing depression in patients, increasing motivation, and facilitating communication, has made pets an essential part of human lives. At the same time, the changing nature of interpersonal relationships and the development of technology, resulting in people opting for a more introverted lifestyle, have led to an increase in pet ownership or a stronger bond with existing pets. Pet ownership is a complex and comprehensive issue. The close bond established between humans and pets does not always lead to beneficial effects and can sometimes cause problems. The adoption of pets by couples and the question of who will retain custody of the pet in the event of a divorce is a frequently debated issue worldwide. The problems and disruption of a peaceful environment experienced by divorcing couples affect not only the children but also the pets. Disagreements over who will take care of the pets during the divorce process can prolong the divorce case. This study will address the statistical prevalence of pet ownership, the need for pets among humans, and the ownership and property rights of pets. The criteria used by courts to decide on implicit contact and residence rights for certain animals among pet owners experiencing irreparable separation pain will be outlined and emphasized. Thus, both the existing legal deficiencies and potential ways to address these deficiencies will be examined, and recommendations will be proposed. Keywords: divorce, pet custody, pets in divorce, protection of pets
