Abstract (EN)

The subject of this thesis is the principle of adversarial trial, which is one of the most important consequences of the right to a fair trial, and which is dominate to procedure law, and in the light of this principle, the taking and discussion of evidence in criminal procedure. In this context, in the first part of the thesis, the principle of contradictory reasoning is discussed, and then the substitution of evidence and discussion in criminal procedure is mentioned. In the third part of the thesis, in the context of substitution and discussion of the evidence, the method of direct questioning, which has a special feature of the statement evidence, is examined.
