Abstract (EN)

The institution of conciliation, which entered the Turkish legal system in 2006, has been carried out by independent and impartial conciliators in our country as of 2017. Considering this system, where persons who meet certain criteria and receive the training planned by the Ministry of Justice Alternative Solutions Department can become independent and impartial conciliators, it is of great importance that the conciliators' knowledge in the field of communication is sufficient as well as their knowledge of law. It is an obvious fact that the person(s) who will act as a conciliator in the conciliation system, which is based on negotiation, should have communication skills above the standard as well as legal education. In this system, which is based on the agreement of the parties, persuasive communication forms the basis of the negotiation methods to be applied by the conciliators who are given the task of negotiating between the two parties. The main starting point of the study is to determine the applicability of the motivated sequence technique developed by Alan Houston Monroe from the perspective of persuasive communication. In this study, which maintains its originality as it is the first study conducted in this field in the literature review; it was concluded that the training provided within the scope of conciliator training is insufficient in terms of persuasive communication and that the use of the motivated sequence technique developed by Alan Houston Monroe by conciliators will have a positive effect on the course and outcome of the conciliation process and will play an important role in the reconciliation of the parties.
